Terms of Service

The rules that govern access to and use of Attiver.

1. Agreement

These Terms of Service (“Terms”) govern access to and use of Attiver, including attiver.com and app.attiver.com. Attiver is operated by Kodex Bilgi Teknolojileri Anonim Şirketi, Altınşehir Mah. 228. Sok. No:44, 16230 Nilüfer/Bursa, Türkiye, MERSİS 0574094840500001.

By creating an account or using Attiver, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent. If a separate order form or enterprise agreement applies, that agreement controls to the extent of a conflict.

2. The service

Attiver is a digital marketing orchestration platform. Depending on your configuration and available integrations, it may ingest business and marketing signals, organize funnel and performance data, surface diagnoses and opportunities, recommend or coordinate actions, and execute certain actions through connected systems.

Automation remains permission-bound. Attiver may only take actions that are available through your connected services and allowed by the permissions, approvals, guardrails, and automation settings you configure.

3. Accounts and authority

You must provide accurate account information and keep credentials secure. You are responsible for activity performed through your account and for ensuring that users you invite have appropriate authority. If you connect a third-party advertising, analytics, billing, CRM, or other account, you represent that you have authority to grant Attiver the requested access.

4. Connected services

Third-party services are governed by their own terms, APIs, availability, permissions, and policies. Attiver is not responsible for a third party changing or discontinuing an API, rejecting an action, suspending an account, altering attribution, or otherwise changing its service. You are responsible for complying with the terms and policies of every connected service.

5. Marketing decisions and automated actions

Marketing platforms are dynamic and outcomes cannot be guaranteed. Diagnoses, recommendations, forecasts, prioritization, or automation produced by Attiver may be affected by incomplete data, provider delays, attribution limitations, configuration, market conditions, or model uncertainty.

You remain responsible for your marketing strategy, budgets, legal compliance, claims, audiences, creative materials, and business decisions. Where Attiver offers approval controls or guardrails, you are responsible for configuring them appropriately for your organization and risk tolerance.

6. Acceptable use

You may not use Attiver to violate law, infringe rights, gain unauthorized access, distribute malware, manipulate or overload systems, conceal unlawful activity, process data you have no right to use, or bypass provider restrictions. You may not attempt to reverse engineer or interfere with Attiver except to the extent a restriction is prohibited by law.

7. Data and content

You retain rights in data and content you submit or connect to Attiver. You grant us the limited rights necessary to host, process, transmit, and transform that data to provide and secure the service. You are responsible for ensuring you have the rights and notices required to provide the data to Attiver.

8. Intellectual property

Attiver, its software, interfaces, documentation, branding, and related materials are owned by Kodex or its licensors and are protected by applicable intellectual property laws. These Terms grant only a limited, non-exclusive, non-transferable right to use the service during your authorized access.

9. Fees and subscriptions

Any paid plan, usage limit, renewal term, tax treatment, refund rule, or billing commitment will be presented in the applicable checkout, order form, or account billing interface before it becomes binding. We will not infer a paid commitment from this marketing website alone.

10. Availability and changes

We may improve, modify, add, or remove features. We may suspend access where reasonably necessary for maintenance, security, suspected abuse, legal requirements, non-payment, or protection of the service. We aim to communicate material changes where practical.

11. Disclaimers

To the maximum extent permitted by applicable law, Attiver is provided on an “as is” and “as available” basis. We do not warrant uninterrupted operation, error-free outputs, specific advertising performance, increased revenue, reduced acquisition cost, or any particular commercial result.

12. Limitation of liability

To the maximum extent permitted by applicable law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data, except where such limitation is prohibited by law. Any additional liability cap applicable to a paid subscription should be stated in the relevant order form or commercial terms.

13. Termination

You may stop using Attiver at any time, subject to any agreed subscription terms. We may suspend or terminate access for material breach, unlawful use, security risk, or as otherwise permitted by an applicable agreement. Provisions that by their nature should survive termination will continue to apply.

14. Governing law

Unless mandatory consumer or local law provides otherwise, these Terms are governed by the laws of the Republic of Türkiye. Disputes are subject to the competent courts and authorities determined under applicable law.
